St. Clair Shores police: DoorDash driver beat eatery owner after argument A DoorDash driver accused of attacking a St. Clair Shores restaurant owner last weekend after a dispute has been charged, officials said. Daveon Jahmel Godbold, 20, was arraigned Tuesday in 40th District Court in St. Clair Shores on five criminal charges, police in the city said in a statement. The Eastpointe resident is charged with unarmed robbery, resisting arrest, malicious destruction of property valued between $200 and $1,000, aggravated assault as well as the delivery and manufacture of marijuana. A magistrate set Godbold's bond at $25,000 and scheduled his next court hearing for Tuesday, according to police and court records. The magistrate also ordered the defendant to wear a GPS tether if he posts bond, officials said. Court records on Wednesday said Godbold is representing himself. If convicted, he faces up to 15 years in prison for the robbery charge, up to two years for resisting arrest, up to a year for the destruction of property charge, up to a year for aggravated assault and up to four years for delivery of marijuana charge. Authorities allege Godbold and another man assaulted the owner of the Amigos Street Tacos restaurant on Greater Mack. Police said they were called to the business at about 7 p.m. Saturday for a report of a robbery and assault. According to a preliminary investigation, the restaurant's owner was assaulted by a DoorDash driver after they got into an argument. Detectives said the suspect tried to grab a food order, but the business owner refused. The suspect assaulted the owner and broke a window at the restaurant, according to officials. Investigators said the suspect left the business but returned with another man. The two men then assaulted the restaurant's owner, according to authorities. Police said they have not yet identified the second assailant. St. Clair Shores police located the suspect in a vehicle near the restaurant and conducted a traffic stop. Detectives said officers arrested the suspect. The incident is the latest in Metro Detroit involving a DoorDash driver. Also on Saturday, an 18-year-old man and a 17-year-old allegedly carjacked a DoorDash driver in Southfield and led police on a car chase. Last week, an Oak Park man accused of shooting a DoorDash delivery driver in March was charged. Attorney for St. Clair Shores election workers suggests political motivations by Nessel An attorney suggested criminal charges against two St. Clair Shores election workers for allowing double voting were “at least in part” motivated by the politics of Democratic Attorney General Dana Nessel because Republican Macomb County Prosecutor Peter Lucido didn’t charge them. Attorney Robert Ihrie also blamed state elections officials for providing flawed election software, which he said led to the charges against Patricia Guciardo and Emily McClintock during Monday's arguments in Macomb County Circuit Court in Mount Clemens. Ihrie is defending Guciardo and McClintock against the state’s appeal of St. Clair Shores district court Judge Joseph Oster’s dismissal of the charges against them last December following a preliminary examination. They were charged with falsifying election records, voting absentee and in person, offering to vote more than once, and aiding and abetting for allowing two voters to vote absentee and in person in the Aug. 6 primary. Ihrie pointed out to Macomb County Circuit Court Judge Joseph Toia that Nessel brought the charges against the pair and five other individuals for the four alleged instances of double voting last October after Lucido declined to press charges and weeks before the Nov. 5 election when Lucido was challenged by Democrat Christinia Hines. “The attorney general went on television, and she spoke as much about how Prosecutor Pete Lucido didn’t charge the defendants in this case as she did about the defendants and the case itself,” Ihrie said in court. “I would be remiss if I did not at least suggest that these charges were wrongly brought against my clients, both of them whose lives have been completely and totally turned upside down — felons, almost —and all they did was push a button, not knowing anybody (the voters), what the vote was. “I just wanted to suggest that these charges at least, in part, were politically motivated.” Ihrie also told Toia that the election software provided by the state contains a defect that allowed the alleged double-voting to occur. Guciardo and McClintock were both temporary election employees at the city clerk’s office call center, handling questions from poll workers. In the two incidents, they were called by poll workers whose information indicated the prospective voters who showed up at their precinct had received and returned an absentee ballot. So McClintock and Guciardo each chose an option to “reject” the two voters’ absentee ballots, unaware that they had already been submitted for counting, Ihrie said. Officials said another spot on the software indicated the ballots were returned. Ihrie added that the two women actually intended to prevent double voting, which, Ihrie contended, is the opposite of what is alleged. He said they did not realize that their decision to choose the “reject” option on the computer menu had no impact at that time. “That language to ‘reject’ a ballot would give a normal person the thought, the idea that even though that ballot may have been received, it’s now going to be rejected, ‘Go ahead and let the person vote, I reject the ballot,’ he said. “It turns out that is not true.” He said it was unclear whether those ballots had actually been counted by that time on Aug. 6. But he noted that St. Clair Shores City Clerk Abby Barrett caught the mistake later that night, contacted county officials, and the votes were not counted. After the hearing, Bloomfield Township Clerk Martin Brook said he and other municipal clerks have complained to state officials about the flaw but have been told it will not be fixed. In his township, he said the same mistake has happened a couple of times in recent years in which an election clerk overlooks the notation that the ballot has been received and chooses to reject the ballot although that had no impact and the voter was allowed to cast two ballots. In his arguments, Assistant Attorney General Richard Cunningham told Toia that Oster “abused his discretion” in throwing out the case. Cunningham said the case raises questions of fact of which the legal ramifications could be determined by a jury. “They (election workers) have a duty to check in the Qualified Voter File to see if anything changed,” Cunningham said. “They willfully falsified the record by changing it to received to rejected … which enables a second vote to occur. They had knowledge he is voting a second time.” Toia indicated he would issue an opinion. Guciardo was among seven to eight people who attended the hearing. McClintock was not present. Of the seven people charged in the case last fall, four were voters and three were election workers. Charges have been dismissed against the trio of election workers, although the state is also appealing the dismissal against election worker Molly Brasure. The state also has filed an appeal in the dismissal of the case against voter Geneva O’Day. Three voters — Douglas Kempkens, Stacey Kramer, and Frank Prezzato — remain charged with felonies of voting absentee and in person and offering to vote more than once. Kempkens Jr. faces a May 12 pretrial hearing in front of Toia. Prezzato is scheduled for a May 14 pretrial in front of Circuit Court Judge Anthony Servitto. Want to comment on this story? Man arrested after police find dead woman in St. Clair Shores Police discovered a deceased female when they responded to a call at a residence near 11 Mile Rd. and Roy St. in St. Clair Shores on Saturday. St. Clair Shores officers detained a male resident shortly after noon.  While securing the scene, they found the deceased female and said it appears she died from “unnatural causes.” The male resident was taken into custody and is being held at the Macomb County Jail.  The case is being investigated and will be reviewed by the Macomb County Prosecutor's Office.
