7. Under the recent #Semenya decision of the Grand Chamber of the #ECtHR, the #CAS and the Swiss Federal Supreme Court have to exercise a strict review of the compatibility of the SGBs' rules and decisions when they affect the fundamental rights of athletes.
The final post of the symposium by @marjolaineviret.bsky.social, Emilie Weible and Cláudio Cerqueira focuses on the impact of the #Semenya judgement from a Swiss perspective.

This case will be a test case to see how the #CAS and potentially the Swiss Federal Supreme Court implement the #Semenya judgement of the Grand Chamber of the #ECtHR.
Algerian Olympic Champion #ImaneKhelif filed an appeal at #CAS early August against a #WorldBoxing decision declaring her ineligible to compete for upcoming World Boxing event after she refused to undergo genetic sex testing.

Thursday was all about #Semenya, but in a very interesting judgement a Belgium court found that the #UCI rules barring access to female competitions to transgender athletes are contrary to EU anti-discrimination rules!
15. To sum up, this ruling is a big deal for the accountability of transnational sports governance and, to a lesser extent, for the rights of intersex athletes to participate in female competitions.

#Semenya Thread!
It took me a while to digest the judgement, but here are some takeaways.
Nutshell: Unlike other commentators, I think the #GrandChamber judgement can be more transformative for transnational sports governance than the Chamber's ruling.

Meet Ms Semenya an intersex female who has had her human rights violated by the @worldathletics.org for being intersex
She is a 3-time World Champion in the 800m and 2-Olympic campaign

Caster #Semenya wins her ECtHR case - but with a GC decision that is VERY different from the Chamber ruling. Court rules (very oddly, IMHO) that Switzerland has no jurisdiction in relation to Art. 8, 14 and 13 ECHR; finds violation of Art. 6(1). Lots of scrutiny of compulsory sport arbitration.
It's #Semenya day!
Today, the Grand Chamber of the #ECtHR will deliver its judgment in the case #Semenya v. Switzerland (live on YouTube at youtube.com/@EuropeanCou...).

#Sportslaw Mega-Breaking!
#Semenya ruling of the Grand Chamber of the #ECtHR to be released on 10 July.
This will be a fork-in-the-road decision for the future place of #HumanRights (and the #ECHR in particular) in transnational sports governance.

I think it’s more about levels of testosterone vs trans !! In track& field after an unfair dominance by a female athlete - established a range more in line with female levels. It’s more complex than just trans but gender assigned at birth . #Semenya An all or nothing approach may not be the answer
Join me in two weeks at the #SpoHo in Cologne for a lecture on the #CAS at 40 and its looming midlife crisis.
I'll talk about the challenges faced currently by the CAS and how to overcome them (or not).
