He said this on Monday during his formal bail hearing at the Windhoek Magistrates Court before magistrate Monica Andjaba on Wednesday. “The complainant requested N$10 000 to apparently pay a policeman to make the case go away,” Hengari told the court. Hengari said there was a meeting that took place at a law firm in Windhoek at the complainant’s request. Present at the meeting was her friend, whom Hengari claimed also pushed for the alleged payment. He said he refused to pay the N$10 000 but later handed them N$200. “I went into my wallet and found the N$200 that I gave her. As soon as I gave her the money, less than a minute later, the police were knocking on my door,” he testified. He denied allegations that he tried to bribe the complainant with N$222 000. “There was no N$222 000 that I gave to the complainant. I had N$222 000 in my bag, but that money was for paying workers at my farm. The only amount the complainant requested from me was N$200. We are now wasting time and resources over N$200. There was no N$222 000 transaction between us,” Hengari told the court. Hengari and his co-accused, the complainant’s older brother, were arrested on 26 March 2025 on charges of defeating or obstructing the course of justice. Both men have been in custody since, and Henagri is now seeking to be released on bail. He told the court that before his arrest, he met the complainant at Arebbusch Lodge in Windhoek. She was accompanied by a friend who works in the legal department at Old Mutual, while police officers waited in a car outside. He said the complainant was reportedly staying in a safe house during the ongoing investigation. “During that meeting, they handed me a settlement agreement document. We then proceeded to have dinner and socialise thereafter,” he said. Hengari also testified that in the days leading up to his arrest, he and his co-accused agreed to approach lawyer Elia Shikongo to help draft a retraction and apology letter regarding the rape allegations, which had already been published in the media. He asked the court to grant him bail, saying he is not a flight risk. “I’m going to be 60 in October, and I have no intention of absconding and starting a new company. I want to slow down and focus on community development.” Hengari also listed his business interests and community roles. He said he is a trustee in Aquaculture Africa, a company valued at N$1.6 billion. He owns 100 shares in Capital and Sancom Investments, as well as in Anirep. He also owns a farm between Windhoek and Okahandja worth N$20 million. “I’m also a trustee of the Tsumkwe Gam Investment with the late Kazenambo Kazenambo, where the community owns 24%,” Hengari added. New charges await Hengari in next court appearance Allexer Namundjebo Former Minister of Agriculture, Water and Land Reform, Mac Albert Hengari, will face new charges when he next appears in court.  These include contravening Section 34(a) of the Anti-Corruption Act (Act 8 of 2003) and incitement to commit a crime under Section 18(2)(b) of the Riotous Assemblies Act of 1976.  This follows a letter from Prosecutor General Martha Imalwa to Hengari’s legal firm, Dr Weder, Kauta & Hoveka Inc. Imalwa, in the letter, notified Hengari’s legal team that the state intends to oppose bail on multiple grounds, including the seriousness of the offences, the strength of the state’s case, potential interference with the ongoing investigation and witnesses, and public interest concerns. Imalwa clarified that Hengari’s arrest was not related to rape allegations but rather to suspected corruption.  She responded to the defence’s request for disclosure of evidence, saying the investigation was still in its early stages.  “Investigations are at an infancy stage; thus, the disclosure of documents or materials as requested cannot be satisfied at this juncture, as these are yet to be received and reviewed by this office,” Imalwa explained. Regarding the request for DNA results, Imalwa noted that her office had not yet received such results and could not provide them. Earlier, Hengari’s lawyers had demanded full disclosure of DNA results, all charge sheets, the grounds for arrest, documents the State intends to use during the bail hearing, and any warning statements issued by their client.  Hengari was arrested two weeks ago for allegedly attempting to bribe a 21-year-old woman with N$222 000 to withdraw a rape case against him.  This is part of an investigation into 11 criminal allegations, including rape, kidnapping, abortion, supplying liquor to a minor, and administering prohibited substances under the Immoral Practices Act.  The complainant claims Hengari abused her when she was 15 years old. Hengari (59) and his 30-year-old co-accused made their first court appearance before Magistrate Monica Andjaba in Windhoek on Wednesday.  Both face charges of attempting to obstruct justice.  State prosecutor, Seredine Jacobs, strongly opposed bail for both accused, citing the seriousness of the case, the strength of the evidence, the risk of interfering with investigations, and public interest.  The second accused, whose identity cannot be disclosed as he is reportedly related to the complainant, is a resident of Germany and considered a flight risk. Jacobs stated that there are still several outstanding witness statements and forensic reports, and investigators are extracting data from electronic devices.  The case has been postponed to 3 June 2025 for further investigation. Hengari resigned from his ministerial position recently after serving just over a month since his appointment on 22 March 2025 by President Netumbo Nandi-Ndaitwah.

Hengari accuses police of public manipulation Justicia Shipena  Former Agriculture Minister Mac-Albert Hengari has accused the Namibian Police of criminal conduct, claiming they attempted to embarrass him and manipulate public opinion in a rape case he is involved in. In a letter dated 2 May 2025, Hengari’s legal team, Dr Weder, Kauta & Hoveka Inc., alleges the police violated legal procedures and unlawfully disclosed sensitive information.  The letter demands the release of key documents for formal bail proceedings. Hengari made his first court appearance last week alongside his co-accused on charges of attempting to obstruct justice.  He was denied bail, and the case was postponed to 3 June 2025 for further investigation. Hengari faces allegations that on 26 April 2025, he tried to obstruct justice by offering the 21-year-old complainant N$222,000 to withdraw the rape charges she had filed against him. His lawyers have requested several documents, including all charge sheets, the grounds for opposing bail, and evidence the State intends to use in the bail hearing. They also seek copies of any statements made by Hengari, including warning statements and those under Section 335 of the Criminal Procedure Act. Hengari was arrested last month after allegedly attempting to bribe the complainant with N$222,000 to withdraw the rape charges.  This arrest follows an investigation into 11 criminal charges, including rape, kidnapping, abortion, supplying liquor to a minor, and administering substances in violation of the Immoral Practices Act.  The allegations involve a 21-year-old woman who claims Hengari repeatedly raped her since she was 15. The demand is made in a letter that lawyer Patrick Kauta of the law firm Dr Weder, Kauta & Hoveka Inc addressed to the control prosecutor of the Windhoek Magistrate’s Court on Friday. In the letter, Kauta is alleging that Hengari’s arrest was carried out in the presence of a newspaper representative, who was allowed to photograph the scene unhindered, “to embarrass the suspect and influence public opinion and interest”. A complainant accusing Hengari of rape was also present at the scene of Hengari’s arrest on 26 April, after Namibian Police inspector general Joseph Shikongo had been quoted in the media as having said that the complainant was in a safe house, Kauta says in his letter. Hengari’s fall casts a shadow over NNN’s start Allexer Namundjembo Political analysts say the arrest of former agriculture minister Mac-Albert Hengari has exposed weaknesses early on in President Netumbo Nandi-Ndaitwah’s leadership. Political analyst Henning Melber said the situation reflects poor judgement in Cabinet appointments. “This is a bad omen for NNN’s first weeks in office. It indicates that there was no proper vetting process done for the Cabinet appointments. Given the evidence already existing, Hengari should never have become a minister,” he said. Melber added that “innocent until proven guilty has a different meaning”. He said Nandi-Ndaitwah’s image of moral leadership had been damaged and questioned how her Christian values allowed Hengari’s appointment. “I am afraid that NNN has to eat humble pie on a number of matters. A bad, if not incompetent, recruitment of ministers is one of these. Her position, as guided by moral leadership, has been damaged,” said Melber. Political analyst Johannes Sackaria said he was not surprised by Hengari’s arrest. He suggested that investigations were already underway and that the president may have had access to crucial evidence before events unfolded publicly. “Maybe the president had some evidence leading him to write the letter on the 23rd, but it was probably not communicated, as there was some evidence needed before it was made public,” Sackaria said. Sackaria added that the way the case has been managed raises concerns about how the new administration is operating. “If this is how they are operating, the new administration may be questionable,” he added. Director of the Institute for Public Policy Research, Graham Hopwood, said the most important development is that Hengari is now out of both Cabinet and the National Assembly. “Since there is no precedent for such a situation in independent Namibia, there is no established procedure for handling it. The most crucial aspect going forward is to ensure that his replacement – and any future appointments – are subject to stringent due diligence,” he said. He stressed that Cabinet members must be held to the highest ethical standards and that any hint of impropriety should automatically disqualify candidates. The criticism follows an announcement from the Presidency that Nandi-Ndaitwah had relieved Hengari of his duties, effective Wednesday, 23 April. However, confusion grew after it emerged that Hengari did not resign publicly, and the presidency did not confirm his resignation beforehand. Presidential press secretary Alfredo Hengari on Sunday only confirmed that the disgraced Hengari is no longer a member of the executive and the National Assembly. The press secretary told the Namibian Broadcasting Corporation (NBC) that the former minister had indeed resigned only after his arrest.  The resignation letter, according to the press secretary, was submitted following the incident, casting doubt on whether the resignation was voluntary or a reaction to the arrest. Hengari was taken into custody on Saturday after allegedly attempting to bribe the victim to drop charges in an ongoing rape investigation. According to the Inspector General of the Namibian Police, Lieutenant General Joseph Shikongo, Hengari is expected to face formal charges and make a court appearance soon. “The team is working to compile the charges, and he will be charged during the course of the day so he may appear in court later today,” Shikongo said.
